NORTH CAROLINA
MITCHELL COUNTY

The Mitchell County Board of Commissioners met in special session on June 21, 2007 at 10:00 a.m. in the Commissioner’s Conference Room, Administration Building, Bakersville, NC. Those present for the meeting were Phil Byrd, Chairman; Lisa Sparks, Vice-Chairman; Mike Hensley, Member; Patrick Phillips, Member; Jim Saylor, Member; Phil Castro, Interim County Manager and Kathy Young, Clerk to the Board. Also present were Hal Harrison, County Attorney; Mavis Parsley, Finance Officer and Donny Wisor, Reporter with the Mitchell News-Journal.

  1. CALL TO ORDER – Chairman Byrd called the meeting to order at 10:00 a.m.

  2. INVOCATION - Commissioner Saylor gave the invocation

  3. PLEDGE OF ALLEGIANCE – Chairman Byrd led the Pledge of Allegiance.

  4. ADDITIONS OR CHANGED TO THE AGENDA - None

  5. USDA – Roger Davis, Program Director from USDA Rural Development Communities Facility Program in Raleigh told the Board he brought greetings from John Cooper who asked him to come and speak to the Board about the jail issue. The reason for USDA to be able to loan money for the Mitchell County Jail, Spruce Pine Fire Department, renovations at Mars Hill College and Swain County Jail is after the storms came through the western part of the state in 2004, our congressional delegation approved a special funding initiative. This put a considerable amount of dollars in our pot to use for projects. When those dollars were approved they were approved just to help economic development or anything that needed to be done in those counties receiving a presidential declaration as a result of the storms. So there by our program had some big bucks for a period of time. Out of that fund is where the 4.5 million appropriation came from for the jail. He stated that in 2007 those dollars were gone. There will not be any more of those dollars unless there is another natural disaster and they might not be able to be used like they were this time. This year for the whole State of North Carolina they received 11 million dollars. We are now back to the old way of doing projects that are in the 2 to three hundred thousand dollar rage. The point he is making is the 4. 5 million dollar appropriation is on the books for Mitchell County to build a jail. He understands that the Board had reconsidered and voted to de-obligate the money. He has the file on his desk in Raleigh from Marvin saying to cancel the obligation. If we cancel the obligation, those dollars are gone forever. Those dollars were obligated at 4.18 percent fixed. There are no bond counsel fees. This is the most inexpensive way to borrow money for Mitchell County. The loan has a term of 40 years, but it does not have to be forty years. The term can be whatever the County wants. Mr. Davis asked the Board to take a few minutes and discuss this one more time to make absolutely certain that Mitchell County wants to cancel the obligation on the money. The money cannot be called back once is de-obligated. John Cooper asked the Board to please reconsider their last decision on the loan.

  6. DSS Contract with Rosa Sistare – Commissioner Saylor moved to approve the DSS Contract with Rosa Sistare (a copy is hereby attached and becomes a part of the minutes). Commissioner Hensley seconded the motion and it carried unanimously.

  7. Budget Amendment # 4 for FY 2006-2007 – Commissioner Hensley moved to adopt Budget Amendment # 4 for FY 2006-2007 (a copy is hereby attached and becomes a part of the minutes). Commissioner Sparks seconded the motion and it carried unanimously.

  8. Budget Ordinance for FY 2007-2008 – Commissioner Sparks moved to adopt the Budget Ordinance for FY 2007-2008 (a copy is hereby attached and becomes a part of the minutes). Commissioner Phillips seconded the motion and it carried unanimously.

  9. ADJOURNMENT – Commissioner Sparks moved to adjourn the meeting. Commissioner Phillips seconded the motion and it carried unanimously.

    The meeting adjourned at 10:30 a.m.
