MITCHELL COUNTY

The Mitchell County Board of Commissioners met in Special Session on March 12, 2012 at 8:30 a.m. in Commissioner’s Conference Room, Administration Building, Bakersville, NC. Those present for the meeting were: Bill Slagle, Chairman; Joe Street, Vice-Chairman; Ken Hollifield, Member; Keith Holtsclaw, Member; Lee Roy Ledford, Member; Charles Vines, County Manager and Kathy Young, Clerk to the Board. Also present were: Hal Harrison, County Attorney; and Corey Hoilman Reporter with the Mitchell-News Journal.

  1. CALL TO ORDER Chairman Slagle called the meeting to order at 8:30 a.m.

  2. INVOCATION Commissioner Hollifield gave the invocation.

  3. REPORTS/PRESENTATIONS

    1. Community Child Protection Team End of Year Report 2011 - Paula Holtsclaw, DSS Director reviewed the Community Child Protection Team End of Year Report for 2011 (a copy is hereby attached and becomes a part of the minutes). She informed the Board that General Statutes require her to make this report to the Board of Commissioners and to the Health District Board.

    2. Child Fatality Prevention Team End of Year Report 2011 - Paula Holtsclaw, DSS Director reviewed the Child Fatality Prevention Team End of Year Report for 2011 (a copy is hereby attached and becomes a part of the minutes). She informed the Board that General Statutes require her to make this report to the Board of Commissioners and to the Health District Board.

      DSS Director Holtsclaw told the Board that these teams meet quarterly on the fourth Tuesday. She informed the Board there would be a State Review Team coming to Mitchell County to review a fatality that happened in April of 2008.

      Chairman Slagle asked County Manager Vines to send the Board out an e-mail asking for any recommendations that they might have on these issues.

  4. CONSENT AGENDA

    1. Legally Binding Commitment Between Mitchell County and North Carolina Renewable Energy, LLC

      Commissioner Holtsclaw moved to approve the Consent Agenda (a copy of the Consent Agenda Items are hereby attached and become a part of the minutes). Commissioner Hollifield seconded the motion and it carried unanimously.

  5. CLOSED SESSION - Commissioner Street moved to enter into Closed Session for discussion on the Appeal of Blue Ridge Housing of Bakersville, LLC. in accordance with 143-318.11(a)(3)To consult with an attorney employed or retained by the public body in order to preserve the attorney‑client privilege between the attorney and the public body, which privilege is hereby acknowledged. General policy matters may not be discussed in a closed session and nothing herein shall be construed to permit a public body to close a meeting that otherwise would be open merely because an attorney employed or retained by the public body is a participant. The public body may consider and give instructions to an attorney concerning the handling or settlement of a claim, judicial action, mediation, arbitration, or administrative procedure. If the public body has approved or considered a settlement, other than a malpractice settlement by or on behalf of a hospital, in closed session, the terms of that settlement shall be reported to the public body and entered into its minutes as soon as possible within a reasonable time after the settlement is concluded.

    Commissioner Ledford moved to go out of Closed Session. Commissioner Street seconded the motion and it carried unanimously.

    Closed Session was held from 8:50 a.m. until 9:27 a.m.

    No action was taken as a result of the Closed Session.

  6. ADJOURNMENT - Commissioner Hollfield moved to adjourn the meeting. Commissioner Street seconded the motion and it carried unanimously.

    The meeting adjourned at 9:28 a.m.
